What is the Subclass 100 Visa?

The Partner Visa (Subclass 100) is a permanent visa for partners of Australian citizens, permanent residents, or eligible New Zealand citizens. It is the next step after the Subclass 309 (temporary) Partner Visa. Here is the important part — you do NOT apply separately for the Subclass 100. When you lodge your Subclass 309 application, you are automatically also applying for the Subclass 100 at the same time. The Department of Home Affairs will assess your permanent visa eligibility after approximately 2 years.

Step-by-Step Application Process

Lodge Subclass 309/100 Application Together

You submit one application that covers both the 309 (temporary) and 100 (permanent) visas. You cannot apply for Subclass 100 on its own.

Receive Subclass 309 (Temporary Visa)

Once your initial application is approved, you will be granted the temporary Subclass 309 visa. This allows you to come to and live in Australia while your permanent visa is being assessed.

2-Year Waiting Period Begins

The 2-year clock starts from the date you first applied (not the date you received the Subclass 309). During this time, you must continue living in a genuine relationship with your sponsor.

Provide Updated Evidence of Your Relationship

Before the 2 years are up, the Department of Home Affairs (or your migration agent) will contact you for updated relationship evidence. This shows your relationship is still genuine and ongoing.

Department Assesses Your Permanent Visa

The department reviews your updated evidence, re-checks health and character requirements, and makes a decision on your Subclass 100 application.

Subclass 100 Permanent Visa Granted

If everything checks out, your visa is upgraded to permanent residency. Congratulations — you are now a permanent resident of Australia!

  • Updated bank statements (joint accounts or transfers between partners)

  • Recent photos together (dated, from the past 1-2 years)

  • Evidence of shared living arrangements (lease, utility bills)

  • Updated passport (if renewed since original application)

  • Any updated legal name change documents

  • Birth certificates of any children born during the visa period

  • Evidence of children living with both parents

  • Updated police clearance certificates (if requested)

  • New health examination (if expired or if circumstances have changed)
