The Partner Visa (Subclass 309) is a temporary visa for people who are in a genuine relationship with an Australian citizen, Australian permanent resident, or eligible New Zealand citizen — and who are currently living outside Australia.
You are the spouse or de facto partner of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen
Your relationship is genuine and ongoing
You are outside Australia when you apply
You meet health and character requirements
You do not have any visa conditions that prevent you from applying
Confirm that you and your partner meet all the relationship, health, and character requirements before starting the application.
Both you and your sponsor (Australian partner) need to create separate accounts on the Australian Government's ImmiAccount portal at immi.homeaffairs.gov.au.
Your Australian partner (sponsor) must first submit a sponsorship application online through ImmiAccount.
Once the sponsor has submitted the sponsorship, you (the applicant) lodge your Subclass 309/100 Partner Visa application online. Both applications are linked together.
Pay the visa application charge (VAC) at the time of lodgement. See the fee section below.
Upload all required documents to support your application (see Documents Required section below).
You will be asked to complete a medical examination with an approved panel physician (doctor). You will receive a health check request through your ImmiAccount.
You must provide police clearance from every country you have lived in for 12 months or more since turning 16.
The Department of Home Affairs will assess your application. They may request additional documents or an interview.
If approved, you will receive the Subclass 309 (provisional) visa. After approximately 2 years, your visa will be assessed again and upgraded to Subclass 100 (permanent), provided you are still in a genuine relationship.
