The H1B visa is a non-immigrant work visa that allows US employers to temporarily employ foreign workers in specialty occupations requiring a minimum of a bachelor's degree or equivalent. It is the primary pathway for Indian professionals — particularly in IT, engineering, medicine, finance, and architecture — to work legally in the United States.
Indian professionals with a job offer from a US employer
Minimum qualification: Bachelor's degree (or equivalent) in a relevant field
The role must qualify as a 'specialty occupation'
US employer must be willing to file a Labor Condition Application (LCA) and petition
Must be selected in the annual H1B lottery (cap-subject petitions)
Cap-exempt employers: universities, non-profits, government research organisations
You must have a full-time job offer from a US company that is willing to sponsor your H1B. The job must be a "specialty occupation" — meaning it needs at least a bachelor's degree. Examples: software engineer, doctor, accountant, architect, nurse.
You need a bachelor's degree (or higher) in the field related to your job. For example, a software engineer role needs a CS or IT degree. Without the right degree, your petition can be denied.
Every year in March, employers submit your basic details online to USCIS and pay a $215 registration fee. This enters you into a random computer lottery. You cannot register yourself — only your employer can.
